In response to the recommendation, the Home Treatment Team performed a comprehensive evaluation on Miss Kelly's current functioning and mental state. The review included a comprehensive medical history and physical examination. The review also included a comprehensive psychological assessment, a family therapy assessment and a psychiatric diagnosis interview.

According to the report Miss Kelly was afflicted by a range of mental health issues, such as bipolar disorder such as bulimia, anorexia and bulimia. She also had an history of addiction to drugs and had experienced domestic abuse. Her symptoms were caused by anxiety, stress, and depression. She was also diagnosed as having bipolar affective and schizoaffective disorders.

Elayaperumal claims Medtronic discriminated against him intentionally because of his race or nationality. He argues that his low performance review in June 2000 and the inability to provide him with certain assignments for projects were influenced by national origin or racism animus.
